Who will manage your affairs should you become incapable due to a stroke, dementia, Alzheimer’s etc.? Who will sign cheques, documents, withdraw money from your account to pay the bills and sign insurance claims? On October 1st 2007 the Government introduced the new Lasting Power of Attorney. This is in two parts - the first dealing with Property and Affairs and the second dealing with Welfare (including healthcare and medical treatment). Unless you have a Lasting Power of Attorney in place you may end up with your partner going to court for permission to handle your affairs. This will be costly and difficult. All of these problems can be resolved through putting a Lasting Power of Attorney in place.
